The Narcotics Control Bureau (NCB) had filed an appeal in the Supreme Court against Bollywood actress, Rhea Chakraborty's bail order granted by the Bombay High Court, and now the supreme judicial body of the country addressed the plea and gave a strong advice to NCB. For the unversed, Rhea Chakraborty was arrested by the NCB on September 8, 2020, under the NDPS act. The NCB also arrested Rhea's brother, Showik Chakraborty, Samuel Miranda (Sushant's manager), Deepesh Sawant (Sushant's former cook) and several other alleged drug peddlers. However, the actress was granted bail from the High Court in October 2020, and since then, Rhea Chakraborty is in headlines, sometimes for visiting the gym where she used to train with her late boyfriend and actor, Sushant Singh Rajput, and sometimes, for her rare public appearances. At the moment, the actress is in the headlines for her upcoming film, Chehre, alongside Amitabh Bachchan, Emraan Hashmi, Annu Kapoor, and others, after it's trailer was released on March 18, 2021, by the makers of the film.
According to a report in the IANS, on March 18, 2021, a bench consisting of renowned Chief Justice, S A Bobde, A S Bopanna, and V Ramsubramanian took note of the NCB's (Narcotics Control Bureau) plea against the Bombay High Court's observations in Rhea Chakraborty's bail order. For NCB, Solicitor General, Tushar Mehta was present at the hearing and received strong advice from the Supreme Court. After the law officer remarked that BMC had made some wide-ranging observations about the NDPS (Narcotics Drugs and Psychotropic Substances) Act, it had become challenging for them to prosecute conviction. On this, the bench clearly stated that NCB cannot challenge Bombay High Court's observations without opposing their decision to grant bail to Rhea. The bench stated, "You cannot challenge the bail order observations without challenging the bail order itself."
After which, Tushar Mehta stated that if they have to challenge Bombay High Court's bail order to actress, Rhea Chakraborty to oppose their observations, they will do it for sure. Tushar also said that NCB would amend their whole petition and challenge Rhea's bail order with a refreshed petition in the Supreme Court. For the unversed, the BMC had granted bail to Rhea on October 7, 2020, and had instructed her to deposit Rs. 1 lakh as a personal bond. Also, the actress' passport was taken and deposited in the court, and Rhea was ordered not to leave the country without the special NDPS court's permission. On December 2, 2020, ANI had taken to their Twitter handle and had revealed that Rhea Chakraborty's brother, Showik Chakraborty was granted bail by special NDPS court in Mumbai. The tweet could be read as "Special NDPS Court grants bail to Showik Chakraborty (Rhea Chakraborty's brother) in a drugs case registered by Narcotics Control Bureau." The decision had come after a revised bail plea was registered in the court from Showik's side. In the appeal, the youngster had claimed that the facts are falsely implicated against him. His bail plea could be read as "In the facts and circumstances of the present case, given that no commercial quantity has been alleged in respect of the applicant, there has been no recovery from the applicant and that all allegations pertain only to small quantities, the embargo imposed by Section 37 of the NDPS Act, 1985 would not be applicable."
