In April 2023, Joe and Sophie moved to England for work. Sophie started filming the mini-series, Joan, while Joe began preparing for the Jonas Brothers world tour, which started in August 2023. They both reluctantly agreed to have their daughters travel with Joe since he had more free time during the day to spend with them. This arrangement was only temporary, and the documents noted that the children would be able to spend time with one parent during the day until their mother finished filming. When the news of their divorce went viral, several reports claimed that Joe had been taking care of their little ones for the last three months. Well, it turns out that it was a mutual decision between the estranged couple.
After filing for divorce, Joe and Sophie met two weeks later to discuss their separation. Sophie mentioned in the documents that they had planned for their children to move to England, but now she claims that Joe is keeping their passports and preventing them from shifting to the English country. The documents state that Joe is in possession of the passports and is refusing to give them back to Sophie, as well as refusing to let the children go back to England with her.
According to legal documents, the ‘Father's attorney’ in Florida confirmed on September 19, 2023, that he will not return the passports to the ‘Mother’ and will not permit the children to return to England. In light of the father's statements, the mother submitted an application under the Hague Convention on September 20, 2023, to the Central Authority for England & Wales to request the return of the children to England.

As per a statement by Joe Jonas' rep, it is reported that he is seeking shared parental custody of their children so that they are raised by both their mother and father and is, of course, also okay with the kids being raised both in the U.S. and England. The rep said:
"This is an unfortunate legal disagreement about a marriage that is sadly ending. When language like ‘abduction’ is used, it is misleading at best, and a serious abuse of the legal system at worst. The children were not abducted."
Joe and Sophie had a pleasant meeting in New York, where Sophie came to spend time with the kids, and they have been with her since then. According to Joe's representative, the meeting resulted in an understanding that they would work together towards a peaceful co-parenting arrangement. However, less than 24 hours later, Sophie changed her mind and expressed her desire to take the children permanently to the UK. She even demanded that Joe should hand over their passports so that she could take them out of the country immediately, which would violate the Florida Court order if Joe complied.
According to a statement from Joe's representative, Sophie was not caught off guard by the divorce. Joe had multiple conversations with her before initiating divorce proceedings in Florida. Sophie knew that Joe would be filing for divorce. The Florida Court has already issued an order that prevents both parents from moving the children, and Sophie was served with this order on September 6, 2023, over two weeks ago.
